Introduction

These Terms of Service (“Terms”) govern your use of the ChatGod.ai platform and the AI chat services provided through the platform. The ChatGod.ai platform allows users to interact with the OpenAI AI language model, ChatGPT, through an instant messaging service such as WhatsApp, rather than through a web browser. ChatGod.ai charges a fee for this service.

By using the ChatGod.ai platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the ChatGod.ai platform.
Please note that these Terms should be read in conjunction with the privacy policy of ChatGod.ai, which describes our practices with respect to the collection, use, and disclosure of personal information.

BY SIGNING UP OR USING OUR SERVICES, YOU AGREE TO BE CONTACTED BY CHATGOD.AI VIA WHATSAPP. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING.

CONSENT TO RECEIVE COMMUNICATIONS

By signing up for our services or using our platform, you explicitly give your consent to receive communications from ChatGod.ai via WhatsApp. These communications may include, but are not limited to, informational messages, updates, promotional offers, and customer support.

OPTING IN

When you sign up or use our services, you automatically opt in to receive WhatsApp communications from ChatGod.ai. This means that you agree to be contacted by us through WhatsApp for the purposes outlined in these terms and conditions.

CONTACT METHODS

ChatGod.ai will primarily use WhatsApp to communicate with you. Please ensure that the phone number associated with your account is accurate and up to date. You acknowledge and understand that WhatsApp has its own terms of service and privacy policy, which you should review separately.

REVOKING CONSENT

If, at any time, you no longer wish to receive WhatsApp communications from ChatGod.ai, you have the right to revoke your consent. To do so, please contact our customer support team and inform them of your decision to opt out of WhatsApp communications. Please note that revoking your consent may limit your access to certain features or services provided by ChatGod.ai.

ALL TERMS AND CONDITIONS SET FORTH HEREIN ARE SUBJECT TO CHANGE AT THE SOLE DISCRETION OF CHATGOD.AI WITHOUT PRIOR NOTICE.

Description of Services

The ChatGod.ai platform provides you with access to the AI chat services of OpenAI through an instant messaging service such as WhatsApp. The platform enables you to communicate with the ChatGPT AI language model and receive responses in real-time.

Please note that the ChatGod.ai platform is provided solely as a convenience to allow you to access and use the AI chat services of OpenAI. OpenAI is responsible for the provision of the AI chat services and ChatGod.ai has no control over the content or quality of the AI chat services.

ChatGod.ai may change, suspend, or discontinue any aspect of the platform at any time, including the availability of any feature, database, or content. ChatGod.ai may also impose limits on certain features and services or restrict your access to parts or all of the platform without notice or liability.

It is your responsibility to ensure that your use of the ChatGod.ai platform and the AI chat services of OpenAI complies with all applicable laws, rules, and regulations.

Use of Services

By using the ChatGod.ai platform, you represent and warrant that:

You have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein;
You are of legal age to form a binding contract with ChatGod.ai;
You will use the ChatGod.ai platform and the AI chat services of OpenAI in accordance with these Terms, any applicable laws, rules, and regulations, and any guidelines or policies published by ChatGod.ai from time to time;
You will not use the ChatGod.ai platform for any illegal, fraudulent, or unauthorized purposes;
You will not use the ChatGod.ai platform to transmit, distribute, post, or submit any information that is unlawful, defamatory, threatening, obscene, harassing, or otherwise objectionable, or that infringes or may infringe third-party rights;
You will not use the ChatGod.ai platform to harm, or attempt to harm, minors in any way.
You will be solely responsible for all activities that occur under your account and for maintaining the confidentiality of your account and password.

If ChatGod.ai has reason to believe that you have violated any of these representations and warranties, ChatGod.ai may suspend or terminate your use of the ChatGod.ai platform and the AI chat services of OpenAI.

User Representations and Warranties

By using the ChatGod.ai platform, you represent and warrant that:

All information that you provide to ChatGod.ai is true, accurate, and complete, and that you will promptly update such information as necessary;
You have the right to use the instant messaging service, such as WhatsApp, through which you access the ChatGod.ai platform and the AI chat services of OpenAI;
You will not use the ChatGod.ai platform to infringe the intellectual property rights of any third party;
You will not use the ChatGod.ai platform to transmit any viruses, malware, or other harmful computer code or files;
You will not interfere with or disrupt the ChatGod.ai platform or the servers or networks connected to the platform;
You will not use the ChatGod.ai platform to access the AI chat services of OpenAI through any means other than through the ChatGod.ai platform.
You acknowledge and agree that ChatGod.ai has no control over, and makes no representations or warranties with respect to, the quality, accuracy, or reliability of the AI chat services of OpenAI, or the results that may be obtained from using the AI chat services.

Limitation of Liability

ChatGod.ai shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, loss of data, loss of use, or costs of procurement of substitute goods or services, arising out of or in connection with these Terms or the use of the ChatGod.ai platform and the AI chat services of OpenAI, whether based on warranty, contract, tort, or any other legal theory, and whether or not ChatGod.ai is advised of the possibility of such damages.
ChatGod.ai shall not be liable for any damages resulting from the loss of access to, or the temporary or permanent suspension or termination of access to, the AI chat services of OpenAI, or from any changes, modifications, or discontinuation of the AI chat services.
ChatGod.ai shall not be liable for any damages resulting from the transmission of any viruses, malware, or other harmful computer code or files through the ChatGod.ai platform or through the AI chat services of OpenAI.
ChatGod.ai shall not be liable for any damages resulting from any unauthorized access to, or alteration of, your transmissions or data.
The limitations of liability set forth in these Terms shall apply even if the remedies set forth herein fail of their essential purpose.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and exclusions may not apply to you. In such jurisdictions, the liability of ChatGod.ai shall be limited to the greatest extent permitted by law.

Intellectual Property Rights

The ChatGod.ai platform and the AI chat services of OpenAI, as well as any content, software, technology, materials, and information provided by ChatGod.ai or OpenAI, are protected by copyright, trademark, trade secret, and other intellectual property laws.
You acknowledge and agree that ChatGod.ai and OpenAI own all right, title, and interest in and to the ChatGod.ai platform, the AI chat services, and any content, software, technology, materials, and information provided by ChatGod.ai or OpenAI, and that you will not use such proprietary information or materials in any way whatsoever except for use of the ChatGod.ai platform and the AI chat services in compliance with these Terms.
You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the ChatGod.ai platform, the AI chat services, or any content, software, technology, materials, or information provided by ChatGod.ai or OpenAI, in whole or in part.
You agree not to copy, reverse engineer, disassemble, or decompile the ChatGod.ai platform or the AI chat services, or otherwise attempt to discover any source code or algorithms or trade secrets underlying the ChatGod.ai platform or the AI chat services.
You agree to comply with all applicable intellectual property laws, and to use the ChatGod.ai platform and the AI chat services only for lawful purposes.
You agree not to use the ChatGod.ai platform or the AI chat services to infringe the intellectual property rights of ChatGod.ai, OpenAI, or any third party.
You agree to indemnify and hold harmless ChatGod.ai and OpenAI against any claims, damages, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to your use of the ChatGod.ai platform or the AI chat services in violation of these Terms or any applicable laws.
The trademarks, logos, and service marks of ChatGod.ai and OpenAI (the “Marks”) are the exclusive property of ChatGod.ai and OpenAI, and you agree not to use the Marks without the prior written consent of ChatGod.ai or OpenAI.

Disclaimer of Warranties

You understand and agree that the ChatGod.ai platform and the AI chat services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
ChatGod.ai and OpenAI do not warrant that the ChatGod.ai platform and the AI chat services will meet your requirements, or that the operation of the ChatGod.ai platform or the AI chat services will be uninterrupted or error-free.
ChatGod.ai and OpenAI make no warranty as to the accuracy, completeness, reliability, or availability of the ChatGod.ai platform or the AI chat services, or as to the results that may be obtained from the use of the ChatGod.ai platform or the AI chat services.
You assume the entire cost of all necessary servicing, repair, or correction resulting from your use of the ChatGod.ai platform or the AI chat services.
You understand and agree that ChatGod.ai and OpenAI shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if ChatGod.ai or OpenAI has been advised of the possibility of such damages), resulting from: (a) Your use of the ChatGod.ai platform or the AI chat services; (b) The interruption, suspension, or termination of the ChatGod.ai platform or the AI chat services; (c) Any bugs, viruses, or other harmful components that may be transmitted through the ChatGod.ai platform or the AI chat services; (d) Your reliance on any content or information provided through the ChatGod.ai platform or the AI chat services; (e) Your use of the OpenAI API and the AI chat services; (f) Any errors or omissions in the ChatGod.ai platform or the AI chat services; (g) The failure of the ChatGod.ai platform or the AI chat services to meet your needs or expectations; or (h) Any other matter relating to the ChatGod.ai platform or the AI chat services.
ChatGod.ai and OpenAI do not endorse any content or information provided through the ChatGod.ai platform or the AI chat services, and ChatGod.ai and OpenAI do not guarantee the accuracy, completeness, reliability, or availability of any content or information provided through the ChatGod.ai platform or the AI chat services.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that ChatGod.ai or OpenAI may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of ChatGod.ai’s and OpenAI’s liability will be the minimum permitted under such law.

Indemnification

The user agrees to indemnify, defend and hold harmless ChatGod.ai and its affiliates, directors, officers, employees, agents, and partners from and against any and all claims, losses, expenses, damages, and costs, including without limitation, reasonable attorneys’ fees, arising from or related to the user’s use of the Services, including but not limited to any violation of these Terms of Service by the user. The user acknowledges and agrees that ChatGod.ai has the right to control the defense of any such claim, and the user will fully cooperate with ChatGod.ai in such defense. The user agrees to be fully responsible for any such claim, and to reimburse ChatGod.ai for any and all damages, expenses, and costs incurred by ChatGod.ai as a result of any such claim.

Termination

The user agrees that ChatGod.ai, in its sole discretion, may terminate the user’s access to all or any part of the Services, with or without notice, for any reason, including, without limitation, breach of these Terms of Service. The user agrees that any termination of the user’s access to the Services may be affected without prior notice, and acknowledges and agrees that ChatGod.ai may immediately deactivate or delete the user’s account and all related information and files in the user’s account and/or bar any further access to such files or the Services. Further, the user agrees that ChatGod.ai shall not be liable to the user or any third-party for any termination of the user’s access to the Services. The provisions of these Terms of Service, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing Law and Jurisdiction

These Terms of Service and any dispute arising out of or related to these Terms of Service shall be governed by and construed in accordance with the laws of the State of Wyoming, without giving effect to any conflict of laws principles that may require the application of the law of another jurisdiction. The user agrees that any action at law or in equity arising out of or relating to these Terms of Service shall be filed only in the state or federal courts located in Wyoming and the user hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. The user agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Services or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Dispute Resolution

In the event of any dispute arising out of or related to these Terms of Service or the Services, the parties agree to first contact each other and attempt to resolve the dispute through good faith negotiations. If the parties are unable to resolve the dispute within a reasonable time period, the parties agree to resolve the dispute through binding online arbitration before the American Arbitration Association in accordance with the rules of the American Arbitration Association then in effect. The online arbitration shall be conducted in accordance with the rules of the American Arbitration Association and the award rendered shall be final and binding upon the parties. The parties agree that the award may be entered and enforced in any court of competent jurisdiction.

The parties agree to waive their right to a trial by jury and their right to participate in a class action lawsuit. Any claim shall be brought in the party’s individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The parties further agree that a court of competent jurisdiction may enter judgment upon the award made by the arbitrator(s).

Entire Agreement

These Terms of Service constitute the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, negotiations, representations, and warranties, whether written or oral, relating to the subject matter of these Terms of Service. No modification, amendment, or waiver of any provision of these Terms of Service shall be effective unless in writing and signed by both parties. The failure of either party to require performance by the other party of any provision shall not affect in any way the full right to require such performance at any time thereafter. The waiver by either party of a breach of any provision shall not be taken or held to be a waiver of the provision itself. If any provision of these Terms of Service is determined to be unenforceable or invalid, such provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions of these Terms of Service shall not be affected.

Modification of Terms

ChatGod.ai reserves the right, in its sole discretion, to modify these Terms of Service at any time. If the modifications materially alter your rights or obligations, ChatGod.ai will provide notice prior to the effective date of the modifications, such as by posting the revised Terms of Service on its website or through other means. Your continued use of the Services after the effective date of any modifications to the Terms of Service will be deemed to be your acceptance of the modified terms. If you do not agree to the modified terms, you must discontinue using the Services.
